COOKIE POLICY
BAMBINI S.r.l., (Tax Code and VAT no. 02578750347) (hereinafter “BAMBINI”), in the person of its legal representative pro tempore, with registered office in Reggio Emilia, Via A. Gramsci, 54/S, in its capacity as Data Controller pursuant to Articles 4(7) and 24 of EU Regulation no. 2016/679 (the “GDPR”), hereby provides the following Cookie Policy (the “Policy”) relating to this website (the “Website”).
1. Legal Framework
1.1. This Policy is inspired by the following EU and/or national legislative provisions (primary and/or secondary):
(i) Directive no. 2002/58/EC of 12 July 2012 (the so-called “ePrivacy Directive”), as amended by Directive no. 2009/136/EC;
(ii) Article 122 of Legislative Decree no. 196/2003 (the “Privacy Code”), which implemented the ePrivacy Directive into the Italian legal system;
(iii) GDPR: Articles 4(11), 7, 12, 13, 25 and 95 (and, in particular, Recitals 30, 32 and 173);
(iv) Guidelines no. 5/2020 adopted on 4 May 2020 by the EDPB, replacing the Guidelines of 10 April 2018 by the WP29;
(v) Decision no. 231 of 10 June 2021 [web doc no. 9677876] by the Italian Data Protection Authority (“Garante Privacy”);
(vi) Recommendation no. 2/2001 of the WP29;
(vii) Opinion no. 2/2010 of the WP29;
(viii) Opinion no. 4/2012 of the WP29;
(ix) EDPB Guidelines no. 8/2020.
2. Cookies and Other Tracking Tools: Definition and Classification
2.1. “Cookies” are, in general, text strings that a website (“publisher” or “first party”) visited by the user, or a different website (“third party”), places and stores—either directly (in the case of the first-party website) or indirectly (through it, in the case of a third-party website)—on the user’s terminal device.
The Italian Data Protection Authority has clarified that the information encoded in cookies may include both personal data under Article 4(1) of the GDPR (e.g., IP address, username, email address, unique identifier) and non-personal data under Article 3(1) of EU Regulation no. 1807/2018 (e.g., language, type of device used).
Alongside (or in addition to) cookies, other tracking tools may exist (and be used), which can be divided into active tools (with similar features to cookies) and passive tools (e.g., fingerprinting).
2.2. Beyond these intrinsic features, cookies (and other tracking tools) may differ in terms of duration (and therefore be classified as “session” or “persistent”, depending on their lifespan), in terms of ownership (depending on whether the publisher acts autonomously or on behalf of a third party), and, most importantly, in terms of purpose, allowing them to be grouped into two main categories:

“Technical” cookies, used solely to “carry out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (Article 122(1) of the Privacy Code).
In this regard, the Italian Data Protection Authority clarified in its Decision no. 231 of 10 June 2021 (in line with its previous 2014 decision) that “analytics cookies” may be considered technical cookies (and therefore may be used without the user’s prior consent) if specific conditions are met to prevent the direct identification of the data subject (single out).

“Profiling” / “Marketing” cookies (so-called non-technical), used to associate specific actions or recurring behavioral patterns in the use of functionalities (patterns) with identified or identifiable users, in order to group them into homogeneous clusters of varying size. This allows the Data Controller to, among other things, provide increasingly personalized services beyond what is strictly necessary, and to send targeted advertising messages (i.e., consistent with the user’s online preferences).

4. Browser Settings
4.1. BAMBINI informs users that they can delete or block the cookies described in Article 3 at any time through the settings available in their browser. However, disabling technical cookies referred to in Article 2.2(i) may affect the quality and speed of the Website’s services and features.

5. Data Subject Rights
5.1. With regard to personal data, BAMBINI informs users that, as data subjects under Article 4(1) of the GDPR, they may exercise the following rights—subject to any limitations under Articles 2-undecies and 2-duodecies of the Privacy Code:

Right of access (Art. 15 GDPR): to obtain confirmation of whether personal data concerning them are being processed and, if so, to access related information (e.g., purposes of processing, retention period).

Right to rectification (Art. 16 GDPR): to correct, update or complete their personal data.

Right to erasure (Art. 17 GDPR): to obtain the deletion, destruction, or anonymization of their data, where the conditions set out therein are met.

Right to restriction of processing (Art. 18 GDPR): to obtain restriction of processing where applicable.

Right to data portability (Art. 20 GDPR): to receive their personal data in a structured, commonly used, machine-readable format and transmit them to another controller, where applicable (e.g., processing based on consent or contract).

Right to object (Art. 21 GDPR): to object to certain types of processing on legitimate grounds.

Right to lodge a complaint (Art. 77 GDPR): to file a complaint with the competent supervisory authority (the Italian Data Protection Authority).
5.2. In addition, BAMBINI specifies that the data subject may also exercise, where applicable, the right under Article 19 GDPR (notification obligation regarding rectification or erasure or restriction of processing) and the right under Article 22(1) GDPR (not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or similarly significant consequences), subject to the exceptions provided for in paragraph 2 of that Article.
5.3. In accordance with Article 12(1) GDPR, BAMBINI undertakes to provide communications under Articles 15–22 and 34 GDPR in a concise, transparent, intelligible, easily accessible form, using clear and plain language. These communications will be provided in writing, electronically, or orally upon verification of the requester’s identity.
5.4. Pursuant to Article 12(3) GDPR, BAMBINI undertakes to provide information on action taken on a request under Articles 15–22 GDPR without undue delay and, in any event, within one month of receipt of the request. This period may be extended by up to two further months where necessary, taking into account the complexity and number of requests (in such case, the user will be informed of the extension and reasons for delay within one month).
5.5. The user may exercise the above rights (except the right under Article 77 GDPR) at any time using the contact details indicated in Article 6.
